By using or accessing www.UMock.com,, you acknowledge and agree to be subject to the following terms and conditions, as well as our Privacy Policy, which is incorporated by reference and governs your use of the Site (the Terms and Conditions and the Privacy Policy shall hereby be referred to as the "Terms"). Please read these Terms carefully, as they contain important information about how you are permitted to use the Site.

The Site shall retain sole discretion over changes to the Terms. As such, User should revisit these Terms to keep up to date with the most current language in the Terms. The Site shall not be required to provide notice to user’s of an update to the Terms at any time and for any reason.

A user’s access or use of the Site is bound by the terms and conditions published on the Site. If you do not agree fully to the Terms, you are no longer permitted to use the Site, whether from indirect access, full or cached version of the Site, and must exit the Site immediately.

The Terms are a legally binding agreement between you and the Site. Visitors of the Site must be at least 18 years of age and have the capacity and power to enter legal contracts with other parties without restriction. It is not our intention to collect information from any visitor under the age of 13 and do not knowingly do so. If you arrived at the Site through any means, either direct or through another site, you must agree to the Terms before proceeding any further.

Definitions

www.UMock.com, owned and operated by UMock, Inc. (the “Site”, “our”, “us”, “we”) is a provider of services and products that assist users with preparation for specific licensing exams. Users of the services and/or products are referred to as “Users”, “you”, “your”. Users must have a registered account and must agree to abide by the Terms while accessing the Site.

1. Use of our products & services

We provide various services and products to the Users of our site for the purpose of exam preparation. By submitting a fee to the Site, Users are granted a limited license that allows you use of the services and products offered by the Site, in accordance with the Terms. In no event shall you have any rights, claims or possession of the Site’s software. Users agree to only use the Site’s software, services and products as follows:

a. Access to content

Users are required to use an internet connection to access the Site. The Site is not responsible or liable to any User that is unable to gain access to the Site due to lack of internet access. The Site is not liable to Users for any fees incurred by an excess use of data while accessing the Site.

The Site is designed for exam preparation alone. Users should access the Site for this reason alone. Any access to the Site for illegal, fraudulent or inappropriate activity is strictly prohibited and any such access will be pursued by the Site to the fullest extent permitted by the law.

Users are only permitted to access Site content in accordance with their respective paid plan or subscription. Another unauthorized access is strictly prohibited.

b. Account sharing

Users are not permitted to give access to any of the Site’s materials, products, services or software to any person besides the individual owner of the account. The Site has full authority to ban any User account if inappropriate sharing of the Site’s use is being performed or Site suspects that inappropriate sharing might be ongoing via an account. Users are not permitted to copy or share any of the Site’s content in any way or form. Users are permitted to save or print content for the sole purpose of individual exam preparation alone. Copying, saving pictures or sharing any of the Site’s content is grounds for immediate account removal without refund. If any Site content is shared with any outside parties, the User will be liable for financial losses by the Site to the fullest extent permitted by the law.

c. System requirements

If User wishes to access and use our products and services at a performance level the application was designed to run at, Users should consult the Site’s required and recommended operating system, internet browser, or software system listing. The Site continually works to maintain updated list of required or recommended systems and has the right to make changes to this listing at any time and for any reason. The Site is not obligated to provide any compensation, monetary or otherwise, to Users for any changes in system requirements or recommendations.

d. Reliance on results

While the Site’s products and services are designed to prepare Users for an examination and will match the examination structure and difficulty as much as possible, the Site cannot guarantee User success on an examination in any form. As such, the Site is not liable or responsible for any examination results, monetary or otherwise, and Users are not eligible for a refund based on examination results alone. Users shall not rely on the Site’s simulated score tracking as an indicator or guarantee for examination results.

e. No performance guarantee

The Site regularly tests and updates our services and products, but cannot guarantee that any or all of the services and/or products will be functioning at any point in time. The Site will strive for as much uptime from software as possible, but in no event will the Site be liable, monetarily or otherwise, for any downtime by the Site’s services, products or software. The Site does not provide services or products with any warranties or conditions of any sort.

f. Mobile device access

The Site recommends that Users access our products, services and software on a computer for a majority of their use. For mobile device access, Users should limit their access to the Qbank, self-assessment exams and tools designed for mobile access. Users are not permitted to access the Site using “jailbroken” mobile devices. The Site cannot guarantee performance on any mobile device and is not liable to Users for lack of performance on mobile devices. The Site is not liable for any mobile device failure or malfunctions of devices at any point in time and for any reason.

g. Export restrictions on international sales

Due to U.S. export restrictions, Users from embargoed countries are strictly prohibited from accessing the Site. Users are expected to perform the research required to see if their country is restricted from Site access through outside sources.

2. Payment processing

In order to access the products and services offered by the Site, Users are required to submit payment to the Site. By submitting payment to the Site, Users agree to the following terms:

a. Submission of payment information

Users may be required to submit certain financial information for payment. The Site will only use this information for processing payments to the Site and will put forth best and reasonable efforts to safeguard your payment information. The Site will keep this information confidential and will never purposefully share this information with any third parties, except where explicitly detailed in writing by the Site.

b. Payment timeline

User agrees that payment processing may take several days and a hold may be placed on the User’s method of payment. The User agrees to allow any ordered payments to the Site to process accordingly and will not cancel, chargeback or block a payment or pending payment by the Site at any time and for any reason. The Site will keep records of charges under User accounts and will provide reports and receipts of charges at their discretion or upon User request.

c. Refunds

Refunds for UMock subscriptions are final. Refunds are determined by multiple factors including if the subscription has been activated, usage, and if the subscription has expired.

“Usage” is defined as either intentionally or unintentionally clicking, or viewing, any page containing content for any subscription you have purchased.

UMock reserves the right to update the refund policy at any time. At the time a refund is requested, eligibility will be determined by the refund policy that was in effect at the time of purchase.

Activating your subscription

When you purchase a UMock subscription, activation is required to start using it. Your subscription plan does not start when you purchase; it starts when you activate it from your account. Once you activate the subscription, you have 10 days to request a refund. Refund requests submitted after 10 days from activation will not be eligible.

Subscriptions that have not been activated are eligible for a full refund within 90 days from purchase, with a $20 administrative processing fee applied. After 90 days from purchase, no refunds will be considered for any subscription that has not been activated.

Subscriptions that have been activated, but not used, are eligible for a full refund within 10 days from activation. After 10 days from activation, no refund will be issued regardless of usage.

Non-refundable subscriptions

Certain subscriptions are non-refundable after activation. The following subscriptions are NOT eligible for a refund after activation:

• All Mock Assessment Subscriptions
• All Renewal Subscriptions
• USMLE Step 3 CCS
• All EKG Review Subscriptions
• All Upgraded Subscriptions
• NCLEX Clinical Math

If any of the above non-refundable subscriptions are purchased but not activated, they are eligible for a full refund within 90 days of purchase, with a $20 administrative processing fee applied. Refund requests for non-activated subscriptions must be submitted within 90 days of purchase. No refunds will be granted for requests submitted past 90 days of purchase.

Upgrade or Downgrade Subscription Policy

Subscriptions cannot be downgraded. However, subscriptions can be upgraded at any time as long as the subscription has not been activated and is not expired.

Upgraded subscriptions that have not been activated are eligible for a full refund within 90 days from the original purchase date, not the upgrade date.

Subscriptions that have been upgraded are not eligible for a refund if activated.

Qbank Refund Policy

Qbank subscriptions that have not been activated are eligible for a full refund within 90 days from purchase, with a $20 administrative processing fee applied. After 90 days, no refunds will be considered for any subscription that has not been activated.

If a Qbank subscription has been activated, you have 10 days from activation to request a refund. No refunds will be considered for requests submitted after 10 days of activation.

For refund requests submitted within 10 days of activation on Qbank subscriptions, UMock will determine the refund amount based on the following criteria:

• Less than 25% of total Qbank questions used: 75% refund of the cost of the subscription.
• 26-50% of total Qbank questions used: 50% refund of the cost of the subscription.
• 51-74% of total Qbank questions used: 25% refund of the cost of the subscription.
• More than 75% of total Qbank questions used: No refund.
• All granted refunds will have a $20 administrative processing fee applied.

How To Get a Refund For Qbank Subscriptions

To cancel your subscription and request a refund, log into your account and click “Manage Plans”. Find the subscription you want to cancel and click “Cancel”. This will display the refund amount you are eligible for and the subscription usage.

Flashcards Refund Policy

Flashcards subscriptions that have not been activated are eligible for a full refund within 90 days from purchase, with a $20 administrative processing fee applied. After 90 days, no refunds will be considered for any subscription that has not been activated.

If a Flashcard subscription has been activated, you have 10 days from activation to request a refund. No refunds will be considered for requests submitted after 10 days of activation.

For refund requests submitted within 10 days of activation on Flashcard subscriptions, UMock will determine the refund amount based on the following criteria:

• Less than 50% of the Flashcards used: 50% refund of the cost of the subscription.
• More than 50% of the Flashcards used: No refund.
• All granted refunds will have a $20 administrative processing fee applied.

How to Get a Refund For Flashcards Subscriptions

To cancel your subscription and request a refund, log into your account and click “Manage Plans”. Find the subscription you want to cancel and click “Cancel”. This will display the refund amount you are eligible for and the subscription usage.

Online Review Course Refund Policy

Refunds for course packages will be determined based on the discounted rate and the individual usage of each subscription within the entire course package, including the Course, Qbank, Flashcards, Assessments, and EKG Review.

If the course subscription is canceled, the entire course package will be automatically canceled and refund amounts will be determined based on the discounted price and usage of each subscription.

Once the course package is activated, all subscriptions within the package will become activated. This includes the Qbank, Flashcards, Mock Assessment, and the EKG Review.

Subscriptions that have been activated, but not used, are eligible for a full refund within 10 days from activation, with a $20 administrative processing fee applied. After 10 days from activation, no refund will be issued regardless of usage.

Standard refund policies apply for the QBank and Flashcards (see “Qbank Refund Policy” and “Flashcards Refund Policy” above). All Mock Assessments and EKG Review subscriptions are non-refundable (see “Non-Refundable Subscriptions Policy” above).

Refund amounts for the 180-Day and 360-Day Course Subscriptions are based on the discounted cost and usage of each subscription, as detailed in the provided graphs.

Other Non-Refundable Situations

Some UMock subscriptions contain a “Reset” option. If this option has been used on any subscription, no refund is eligible.

UMock subscriptions are intended for use on desktop computers or laptops. Mobile compatibility is offered on certain devices as an additional feature. Refunds will not be considered due to the inability to use the subscription on either a supported or unsupported mobile device.

Subscription purchases cannot be converted to another subscription on the same user account and cannot be transferred to another user.

d. Subscription

The User is permitted to use products and services on the Site for which the User has subscribed by way of a submitted payment, in accordance with the following guidelines:

General Subscription Guidelines

By selecting a certain subscription plan and submitting payment, the User has agreed to subscribe to select products and services for the specified period of time listed on the product description page. Content provided to User for subscription products ordered by User will be as described on the corresponding product description pages. The Site has full discretion to make changes to subscribed material as needed to stay relevant with updated examination materials.

Qbank subscription guidelines

When subscribing to Qbank subscription products, the product pages will display a minimum number of questions. While the Site has discretion over questions provided to Users, the Site must always maintain the minimum number of questions listed in the product description.

Subscription activation

Any given subscription period will not start immediately following payment submission and will stay inactive until the User activates the subscription. It is advisable that Users activate their subscription within 150 days following a subscription purchase. If User purchases a combination product package, the individual products within the combination product package may each be activated at separate times and run on different subscription timelines. Users have exactly one year to activate their subscription from the date of purchase, or else the subscription will be cancelled with a store credit being applied to the User account.

Subscription timeline

Once a User activates a subscription, the subscription cannot be suspended, paused or cancelled in whole or in part for any reason. Users are only permitted to access any subscription material while the subscription is active without exception.

User’s will automatically lose access to any and all subscription material immediately following the expiration of the User’s subscription period. The Site is not required, but may choose to, provide advanced notice of an upcoming subscription period expiration.

If the Site determines that the User has violated the Terms, the Site may cut the User’s subscription timeline short without refund.

Access of expired subscription materials

If the User allows a subscription to expire without renewal and wishes to access any of the expired materials, the User will be required to purchase a brand new subscription. Following this purchase, the User may submit a request to the Site to restore expired data to the user’s new subscription material. The Site has full discretion over whether a User’s new purchase will have expired materials rolled over or not.

Subscription changes

A User may be able to make changes to a subscription that has been purchased, but not yet activated. If a User purchases a combination package, all parts must be inactive to make changes. Certain minimum subscription lengths apply to various products. Users may contact the Site to make changes, but Site will have full discretion over whether a subscription is eligible for changes or not. If a User subscription has not yet been activated, the User is eligible to reduce or increase the subscription duration as needed. For combination package purchases, all parts of the package must remain unused to be eligible for a change to the subscription duration.

Subscription renewals

Users are required to renew subscriptions prior to the expiration of a subscription period. The renewal of any subscription will extend the subscription period from the previous subscription expiration date and will automatically begin when the previous subscription expires.

Subscription products that were purchased in a combination product package may be renewed separately without requiring renewals of all of the products in the original combination package being renewed.

Purchasing Subscriptions for other users

Users may have their subscriptions purchased by another individual. To do so, the individual making the purchase should contact the Site and have the User’s account information readily available.

e. Qbank reset eligibility

User’s may or may not be eligible to have their Qbank reset for the purpose of using the Qbank as if it were a brand new subscription. The eligibility for a reset may vary and must be in accordance with the Site’s policies for a reset. The Site will have full discretion over which Qbanks are eligible for a reset. In general, reset options are eligible if a User purchases a new subscription (not a renewal) or a User has had a continuously renewed subscription for a period of 180 days or more without a reset and wishes to request one. The Site generally allows for Qbank resets in these circumstances, but is not required to under any circumstances.

4. Content ownership and use of site content

The Site and all content, images, intellectual property and information on the Site are the Site’s property. Users of the Site shall not be permitted to use content and images found on the Site without express, written permission from the Site.

The Site is not liable for any material posted by Users on the Site forums and Users should not rely on the information posted on the forums by other users. Users should not post any offensive, confidential or misleading information on the Site forums. The Site has the authority to remove any User posts to its forums at any time and for any reason.

5. User data and our privacy policy

Any information you provide to the Site may be used by the Site, stored in our database, or provided to other parties as needed. By using the Site and providing this data, you agree to the policies by which the Site manages your data. Users should review our Privacy Policy to better understand how our Site manages User data.

6. Account ownership and responsibility

Users are required to provide identifying information in order to complete the registration process and set up an account with the Site. User warrants and represents that any information provided is a current, true and accurate representation of the User’s information at that point in time. User is responsible for updating contact information as changes are made.

It is in your best interests to keep your account credentials for the Site confidential. However, if you do choose to allow someone else to use your account, or if someone else accesses your account without your knowledge due to weak account safeguards by the User, you will be held liable for any and all purchases on the Site made from your account. Users should report any suspected fraudulent activity to the Site as soon as possible.

At our sole discretion, we may take action as we deem necessary to stop or remove an account with signs of fraudulent activity.

7. Site design and layout

We reserve the right to determine in our sole discretion the final design, layout and functionality of the Site, which is subject to change from time to time without notice. We do not accept or bear any liability for any loss or damage of any sort resulting from the design or positioning of the copy, content and/or materials available, or lack of availability, on the Site.

8. No affiliation or marks claimed

The Site is in no way affiliated with any United States based licensing examinations or any related organizations. The Site does not make any claim any trademarks, logos or association with the aforementioned parties.

9. Hypertext links

The Site is not liable to Users for any loss, damage or reference made to other sites posted on the Site via Hypertext Links or ads.           

10. Notification of infringement

The Site does not permit Users to post any content on the Site that infringes the copyright or intellectual property rights of another person, entity or group. The Site has the right to remove User access to the Site if the User is a repeat offender of copyright infringement on the Site.

11. Indemnification and limitation of liability

You agree to indemnify the Site and any of its associated personnel from and against any third-party claims of any kind related to your relationship with the Site, including but not limited to reasonable legal fees.

The Site will not be liable for any past, present or future damages of the User claimed to be caused by the Site. The Site’s maximum liability to any User for any reason shall be the fees paid to the Site by the User.

12. Governing law

The Terms serves as an official agreed-upon contract between the Site and the User and any prior agreements, in any method, are hereby terminated. The Terms are governed by Texas state laws in the United States of America and any legal matters shall be handled with the state’s courts. If any part of this agreement is determined invalid by a competent court proceeding or jurisdiction, that invalidation will not impact any other components of this agreement.
